Child Sexual Abuse-An Old Story Being Retold By Jerry Sandusky/Penn State Scandal

A person would have to live in a forest with no TV, radio or internet to have avoided the recent, sad story unfolding at Penn State. Yet,  how many time do we have to hear that the person who does the molesting gains the trust of the child,  and sometimes the parents,  through involvement in “good deeds”  organizations  such as  churches, charities, civic clubs, and other youth programs . It is a simple fact that the sexual predator profile is male, white,  usually married and finds his victims by participation in organizations where youth can be cut off from the normal parent-adult supervision by claiming to need “one on one time” with that young person.

Sadly, the Sandusky/Penn State scandal  is just the tip of an epidemic in our country. According to Chuck Neubauer of the Washington Times (April 23, 2011), “Analysts say the number of children sexually exploited in the U.S. or at risk of being exploited is between 100,000 and 300,000.

“’We know it is a really large number,’ said Anne Milgram, a former high-ranking federal prosecutor who tried and oversaw sex trafficking cases. ‘We know there are a lot of children being victimized. We just can’t tell you what number.’”

As adults, we need to have “eagle eyes” for all children. If you see a child being showered with lots of one on one time, special treatment or gifts, you need to look deeper. Talk to your kids. Ask questions. Dig deeper. Report the abuse.  Seek counsel from a good lawyer.

The abused child may be entitled to compensation from the organization or the abuser.

Adults, and especially parents, are the best line of defense to protect our kids.  Attached here are the mandatory  Sex Abuse Reporting requirements in SC for one who suspects child sex abuse. However, anyone can contact the police and or the South Carolina Department of Social Services and file a complaint.

Actos and Bladder Cancer

Use of the diabetes drug Actos for more than one year has been shown to increase risk of bladder cancer by 40 percent.

In June 2011, the FDA required a change to be made to the Actos label reflecting a 40 percent increased risk of bladder cancer for those who take Actos for more than one year. This announcement was based on the FDA’s review of an ongoing, ten-year study. The FDA also recommended that medical professionals not prescribe Actos to patients with bladder cancer or with a prior history a bladder cancer.

At the same time, results surfaced from a study conducted in France, which also linked Actos use with an increased risk of bladder cancer. As a result, use of Actos has been suspended in France, and Germany has advised doctors not to start any more patients on Actos.

Bladder Cancer Lawsuits Filed

In August 2011, the first lawsuits were filed against Actos manufacturer Takeda Pharmaceuticals blaming the diabetes drug for instances of bladder cancer. Victims are suing for financial compensation for the cost of hospital bills and loss of income, as well as physical and emotional suffering. Legal experts predict that these are the first of many Actos lawsuits that will be filed.

Heart Risks Also a Concern

In 2007, amidst an intense debate over the safety of Type-2 diabetes drugs, the FDA asked the makers of Actos to issue a black box warning about the serious risk of adverse cardiovascular events, including heart attack, heart failure and cardiovascular-related deaths. A black box warning is the strongest FDA-requested label change that can be added to a drug.

How To Make Sure You Have A Good Relationship With Your Lawyer

The key to any attorney/client relationship is communication. Open and honest communication (on both sides) is key to getting the most out of your lawyer. Remember also, this is not a one-way proposition. It is just as easy to turn the foregoing rule around. If your lawyer is the one not communicating , talk to them about it immediately. More than likely, agreement can be reached to avoid problems in the future.

A Cautionary Tale For Injury Victims

By now, most people are aware that Michael Jackson’s death may have involved overuse of prescription drugs . It was widely reported that Michael first became addicted to prescription drugs in the 1990s while recovering from a painful burn he experienced during the filming of a Pepsi ad.

TMZ.com reported that Jackson family members and others were worried for quite some time that Michael was unable to perform as a result of drug use.

Sadly, I’m not surprised. My firm has represented accident victims for many years. Often people who have suffered painful injuries are prescribed highly addictive medications. Most of the time physicians and medical staff carefully monitor their patients’ use of painkillers.

Sometimes, however, highly addictive drugs are prescribed and not closely monitored. When this happens injury victims with no history of illicit drug use can find themselves powerfully hooked on prescription drugs.

The National Institute on Drug Abuse (NIDA) recently released a survey showing a 23% decline in illicit drug use over the last five years. However, the report shows that abuse of prescription drugs is on the increase.

I encourage our seriously injured clients and their families to stay informed about medications they receive. I also recommend that they closely question their doctors and pharmacists about the potential side effects — including risk of addiction — of any medication they are prescribed.

Hospitals No Safer Despite Reform

In 2005,  the  South Carolina Legislature passed  reforms that placed limits on damages for  victims of hospital negligence and medical malpractice. One of the main arguments used by proponents who pushed for this change was  that health care providers would provide better quality care if they were free to practice medicine without the cost and worry of burdensome, “frivolous lawsuits” thereby making hospitals and patients safer.

However, despite this reform and others by states across the country,  a recent study published by the New England Journal of Medicine found that in 2000 to 2007, harm to patients was still common and the number of incidents that injured patients did not decrease during this time.

The most common problems were complications from procedures or drugs and hospital-acquired infections.

“It is unlikely that other regions of the country have fared better,” said Dr. Christopher P. Landrigan, the lead author of the study and an assistant professor at Harvard Medical School. The study is being published on Thursday in The New England Journal of Medicine.

Tragic Prescription Error: $28,500,000 Award Upheld Against Walgreens

As widely reported in the national news media, the Second District Court of Appeal in Florida recently upheld a ruling against Walgreen’s for a tragic prescription error by a teenage pharmacy technician.  The blood thinner prescription was written for one milligram, but the technician erroneously typed in 10 milligrams instead.  The victim, a mother of 3,  suffered a massive and crippling stroke after taking the incorrect dose.  She died at age 46 in 2007.   You can read more about this tragedy by clicking here, but this post is being written to emphasize a few extremely disturbing facts:

A husband, looking through the newspaper, came upon a study that said women use more words than men. Excited to prove to his wife his long-held contention that women in general, and his wife in particular, talked too much, he showed her the study results.  The report stated: “Men use about 15,000 words per day, but women use 30,000.”

His wife thought awhile, then finally she said to her husband, “It’s because we have to repeat everything we say.”

The husband said, “What?”
